गैंगस्टर महादेव महार हत्याकांड फैसला (क्र. 81 से 90)

 

81- इस संबंध में उक्त जप्तशुदा ए-5 के लोहे के कट्टा 303 बोर का, एक खोखा, आर्टिकल ए-6 एवं 303 बोर का एक अन्य कट्टा व 303 बोर का नौ नग जिंदा कारतुस पुलिस उपमहानिरीक्षक के पत्र प्रदर्श पी 135-ए/सी केन्द्रीय न्यायालयीक विज्ञान प्रयोगशाला चण्डीगढ़ प्रेषित किया गया था। तब केन्द्रीय न्यायिक विज्ञान प्रयोगशाला के वैज्ञानिक अधिकारी अ0सा063 डॉ0 पी0 सिदद्म्बरी ने जांच पश्चात प्रदर्श पी 135 का परीक्षण प्रतिवेदन दिया है, जिसके अनुसार उक्त दोनों लोहे के कट्टे ए-5 एवं ए-6 कार्यरत अवस्था में थे, और प्रेषित 303 के कार्टियेज को फायरिंग करने के योग्य थे। इसके अतिरिक्त 303 बोर के नौ कारतुसों में से एल-6 से एल-11 जीवित भी थे। इस संबंध में आरोपी शैलेन्द्र ठाकुर की भी यह प्रतिरक्षा है कि अ0सा07 चंदन साव के धारा 164 के कथन एवं पुलिस बयान मंध आरोपी शैलेन्द्र ठाकुर का नाम नही है एवं अ0सा07 चंदन साव ने आरोपी शैलेन्द्र ठाकुर का केवल टेम्पो से उतरना बताया है। आरोपी शैलेन्द्र ठाकुर की यह प्रतिरक्षा इसलिये स्वीकार योग्य नही है क्योंकि अ0सा07 चंदन साव ने आरोपी शैलेन्द्र ठाकुर की पहचान न्यायालय में की है और उसकी पहचान की कार्यवाही को अ0सा052 यामिनी पाण्डे गुप्ता ने समर्थनकारी साक्ष्य के रूप में प्रमाणित भी किया है। उससे दो कट्टे एवं जीवित कारतुस भी जप्त किये गये हैं।
82- अतः स्पष्ट है कि आरोपी शैलेन्द्र ठाकुर के संबंध में अभियोजन यह प्रमाणित करने में सफल हुआ है कि घटना दिनांक को वह अन्य आरोपियों के साथ मृतक महादेव महार की हत्या करने घाटनास्थल पर उपस्थित था।
83- उक्त विवेचन से स्पष्ट है कि इस न्यायालय के समक्ष अभियोजन के प्रत्यक्षदर्शी साक्षियों, जिनके साक्ष्य का विवेचन उक्तानुसार किया गया है, से यह प्रमाणित होता है कि आरोपी तपन सरकार, आरोपी सत्येन माधवन, आरोपी बॉबी उर्फ विद्युत चौधरी, आरोपी मंगल सिंह, आरोपी अनिल शुक्ला, आरोपी राजू खंजर, आरोपी पिताम्बर साहू, आरोपी छोटू उर्फ कृष्णा, बिज्जू उर्फ महेश, आरोपी शैलेन्द्र ठाकुर, आरोपी अब्दुल जायद उर्फ बच्चा, रंजीत सिंह एवं आरोपी प्रभाष सिंह, मृतक महादेव महार के हत्या के अपराध में सहभागी थे। इस संबंध में आरोपीगण विशेष रूप से आरोपी शैलेन्द्र ठाकुर की यह प्रतिरक्षा है कि आरोपी शैलेन्द्र ठाकुर घटनास्थल पर उपस्थित होने का ही साक्ष्य है,अतः उसे भा0दं0सं0 की धारा 149 के सहयोग से दण्डित नही किया जा सकता है। इस संबंध में आरोपीगण के विद्वान अधिवक्ता ने माननीय उच्चतम न्यायालय का न्यायदृष्टांत 2011 (2) सीसीएससी पेज क्रमांक 1010 (एससी) एवं 1991 मनिसा पेज क्रमांक 35 प्रस्तुत किया है।
84- भा0दं0सं0 की धारा 149 आकर्षित होने के लिये किसी आरोपी का (Over Act)  आवश्यक नही होता है। इस संबंध में माननीय उच्चतम न्यायालय का न्यायदृष्टांत सुनील कुमार एवं एक अन्य बनाम राजस्थान राज्य एआईआर 2005 एस0सी0 1096 के पैरा 7 एवं 8 अवलोकनीय है जो इस प्रकार है:-
7. The pivotal question is applicability of Section 149, IPC. Said provision has its foundation on constructive liability which is the sine qua non for its operation. The emphasis is on the common object and not on common intention. Mere presence in an unlawful assembly cannot render a person liable unless there was a common object and he was actuated by that common object and that object is one of those set out in Section 141. Where common object of an unlawful assembly is not proved,the accused persons cannot be convicted with the help of Section 149. The crucial question to determine is whether the assembly consisted of five or more persons and whether the said persons entertained one or more of the common objects, as specified in Section 141. It cannot be laid down as a general proposition of law that unless an overt act is proved against a person, who is alleged to be a member of unlawful assembly, it cannot be said that he is a member of such an assembly. The only thing required is that he should have understood that the assembly was unlawful and was likely to commit any of the acts which fall within the purview of Section 141. The word 'object' means the purpose or design and, in order to make it 'common', it must be shared by all. In other words, the object should be common to the persons, who compose the assembly, that is to say, they should all be aware of it and concur in it. A common object may be formed by express agreement after mutual consultation, but that is by no means necessary. It may be formed atany stage by all or a few members of the assembly and the other members may just join and adopt it. Once formed, it need not continue to be the same. It may be modified or altered or abandoned at any stage. The expression 'in prosecution of common object' as appearing in Section 149 have to be strictly construed as equivalent to 'in order to attain the common object'. It must be immediately connected with the common object by virtue of the nature of the object. There must be community of object and the object may exist only up to a particular stage, and not thereafter. Members of an unlawful assembly may have community of object up to certain point beyond which they may differ in their objects and the knowledge, possessed by each member of what is likely to be committed in prosecution of their common object may vary not only according to the information at his command, but also according to the extent to which he shares the community of object, and as a consequence of this the effect of Section 149, IPC may be different on different members of the same assembly.
8. "Common object" is different from a 'common intention' as it does not require a prior concert and a common meeting of minds before the attack. It is enough if each has the same object in view and their number is five or more and that they act as an assembly to achieve that object. The 'common object' of an assembly is to be ascertained from the acts and language of the members composing it, and from a consideration of all the surrounding circumstances. It may be gathered from the course of conduct adopted by the members of the assembly. What the common object of the unlawful assembly is at a particular stage of the incident is essentially a question of fact to be determined, keeping in view the nature of the assembly, the arms carried by the members, and the behaviour of the members at or near the scene of the incident. It is not necessary under law that in all cases of unlawful assembly, with an unlawful common object, the same must be translated into action or be successful. Under the Explanation to Section 141, an assembly which was not unlawful when it wasassembled, may subsequently become unlawful. It is not necessary that the intention or the purpose, which is necessary to render an assembly an unlawful one comes into existence at the outset. The time of forming an unlawful intent is not material. An assembly which, at its commencement or even from some time thereafter, is lawful, may subsequently become unlawful. In other words it can develop during the course of incident at the spot instante. 
85- इस संबंध में माननीय उच्चतम न्यायालय का ही न्यायदृष्टांत कृष्णपा एवं अन्य बनाम स्टेट आफ कनार्टका द्वारा पुलिस स्टेशन बाबालेश्वर 2012 क्रिमनल लॉ जर्नल 4347 का पैरा 20 अवलोकनीय है, जो इस प्रकार हैः-
20. It is now well settled law that the provisions of Section 149, IPC will be attracted whenever any offence committed by any member of an unlawful assembly in prosecution of the common object of that assembly, or when the members of that assembly knew that offence is likely to be committed in prosecution of that object, so that every person, who, at the time of committing of that offence is a member, will be also vicariously held liable and guilty of that offence.Section 149, IPC creates a constructive or vicarious liability of the members of the unlawful assembly for the unlawful acts committed pursuant to the common object by any other member of that assembly. This principle ropes in every member of the assembly to be guilty of an offence where that offence is committed by any member of that assembly in prosecution of common object of that assembly, or such members or assembly knew that offence is likely to be committed in prosecution of that object. [Lalji v. State of U.P., (1989) 1 SCC 437 : (AIR 1989 SC 754); Allauddin Mian v. State of Bihar, (1989) 3 SCC 5 : (AIR 1989 SC 1456); Ranbir Yadav v. State of Bihar, (1995) 4 SCC 392 : (AIR 1995 SC 1219 : 1995 AIR SCW 1980)]. The factum of causing injury or not causing injury would not be relevant, where accused is sought to be roped in with the aid of Section 149, IPC. The relevant question to be examined by the court is whether the accused was a member of an unlawful assembly and not whether he actually took active part in the crime or not. [State v. Krishan Chand, (2004) 7 SCC 629 : (AIR 2004 SC 4671 : 2004 AIR SCW 5179); Deo Narain v. State of Uttar Pradesh, (2010) 12 SCC 298 : (2010 AIR SCW 5915)] 
अतः आरोपी शैलेन्द्र ठाकुर को भा0दं0सं0 की धारा 149 के सहयोग से दण्डित किया जा सकता है।
86- इस प्रकरण में आरोपीगण की यह प्रतिरक्षा भी है कि मृतक महादेव महार की हत्या का अपराध कहीं और किया गया है, और शव को मृतक महादेव महार के हत्यारे ने सुभाष चौक में लाकर छोड़ दिया है। इस संबंध में इस न्यायालय द्वारा अ0सा02 केशवप्रसाद चौबे के साक्ष्य में किये गये कथन के आधार पर यह निष्कर्ष दिया जा चुका है कि मृतक की हत्या का स्थल घटनास्थल वाला सुभाष चौक ही है। लेकिन इस संबंध में आरोपीगण के विद्वान अधिवक्तागण ने मृतक के शव का पोस्टमार्टम करने वाले चिकित्सक अ0सा010 डॉ0 जे0पी0मेश्राम के साक्ष्य की ओर न्यायालय का ध्यान आकृष्ट करते हुये यह प्रतिरक्षा व्यक्त किये हैं कि मृतक के सारे शरीर में रायगर मार्टिस उपस्थित था। अ0सा010 डॉ0 जे0पी0मेश्राम ने अपने साक्ष्य की कण्डिका 9 में मृतक की मृत्यु का समय पोस्टमार्टम करने से 24 घण्टे भीतर का होना बताया है। इस साक्षी के साक्ष्य की कण्डिका 13 के अनुसार उन्होंने मृतक के शव का पोस्टमार्टम दिनांक 11/2/2005 को सुबह 9.30 बजे प्रारम्भ किया था। इस साक्षी ने अपने साक्ष्य की कण्डिका 13 में यह भी स्वीकार किया है कि मृतक के पूरे शरीर में रायगर मार्टिस था। किसी भी व्यक्ति की मृत्यु होने पर दो-तीन घण्टे उपरान्त रायगर मार्टिस प्रारम्भ होता है, मृतक के शुरू के 12 घण्टों में रायगर मार्टिस पूरी तरह विकसित हो जाता है, एवं मृत्यु के 12 से 24 घण्टे के भीतर रायगर मार्टिस बना रहता है तथा 24 घण्टे पश्चात रायगर मार्टिस कम होने लगता है। तब इस साक्षी से आरोपी प्रभाष के विद्वान अधिवक्ता द्वारा उनके साक्ष्य की कण्डिका 14 में विशेष रूप से प्रश्न किया गया कि मृतक की मृत्यु पोस्टमार्टम प्रारम्भ के लगभग तीन घण्टे पहले नही की हुई होगी। तब  अ0सा010 डॉ0 जे0पी0मेश्राम ने उसका उत्तर यह कहकर दिया कि ‘‘सही है, साक्षी स्वतः कहता है कि मृतक की छोटी आंत एवं बड़ी आंत में गैसेस मौजुद होना लेख किया है, जो यह दर्शाता है कि शरीर में गैस का निर्माण मृत्यु के तीन घण्टे बाद शुरू होता है। अतः आरोपीगण के विद्वान अधिवक्तागण ने यह प्रतिरक्षा ली है कि अभियोजन के अनुसार मृतक की मृत्यु का समय सुबह 6.28 बजे है, जो अ0सा10 डॉ0 जे0पी0मेश्राम के साक्ष्य के अनुसार संभव नही है, क्योकि मृतक के शरीर में रायगर मार्टिस पूरी तरह प्रारम्भ हो गया था।
87- आरोपीगण के विद्वान अधिवक्ताओं का उक्त तर्क स्वीकार योग्य नही है, जिसका प्रथम कारण यह है कि प्रकरण में ऐसा कोई भी साक्ष्य नही है जिससे यह दर्शित होता हो कि मृतक की मृत्यु के समय 6.28 बजे से पोस्टमार्टम के समय 9.30 बजे तक मृतक का शरीर मर्चुरी में रखा था या नही रखा था। दूसरा कारण यह भी है कि घटना दिनांक 11/2/2005 को ठंड लगभग जाने वाली होती है और गर्मी आना प्रारम्भ हो जाती है। इसके अतिरिक्त रायगर मार्टिस का होना शरीर की प्रकृति पर भी निर्भर होता है। जहां तक मृतक की छोटी आंत में गैस होने का प्रश्न है तो इस साक्षी ने मृतक का पोस्टमार्टम लगभग चार घण्टे बाद किया है अतः गैसेस मौजुद होना स्वाभाविक है। इसके अतिरिक्त इसी प्रकार का तर्क माननीय उच्चतम न्यायालय के समक्ष न्याय दृष्टांत मंगू खान एवं अन्य बनाम स्टेट आफ राजस्थान 2005 एस0सी0 1912 इस न्याय दृष्टांत में भी मृतक की हत्या 11/7/97 को प्रातः 7 से 7.30 बजे के मध्य हुई थी, एवं मृतक का पोस्टमार्टम दिनांक 11/7/97 घटना दिनांक को ही 12 बजे हुआ था। तब अपीलार्थी के अधिवक्ता ने जो तर्क प्रस्तुत किया, उसके परिप्रेक्ष्य में माननीय उच्चतम न्यायालय ने निम्नानुसार अवलोकित किया है:-
9. The learned counsel next contended that the High  Court had grossly erred in not appreciating that the ocular evidence on record was wholly inconsistent with and inexplicable in the light of the medical evidence. In particular, learned counsel drew our attention to the post mortem reports in both the cases. In the case of deceased Isab, the post mortem report dated 11.7.1997 indicated that the body was examined at 12.00 noon on 11.7.97 and certified that death had occurred "within 24 hours prior to PM Examination". The cause of death appeared to be serious injuries caused on the head and skull resulting in wounds going deep into meninges, brain matter coming out through bones and scalp. In the case of the deceased Dandhad, the post mortem report dated 11.7.1997 certified that his body was examined at 11.00 a.m. and death had occurred "within 24 hours prior to PM Examination". In both the cases, the post mortem report indicated "rigor mortis present all over the body". On the basis of these two documents, the learned counsel tried to build up a case that the prosecution story was unbelievable, that the offence had been committed during previous night in the open field by unknown persons and the case had been falsely foisted on the accused on account of previous enmity over the construction of a bund. We see no basis whatsoever for this argument.In the first place, neither post mortem report suggests that the death had taken place exactly 24 hours before the post mortem was conducted. All that the post mortem reports say is that the death had occurred "within 24 hours prior to PM Examination". Undoubtedly, the post mortem examination was carried out at 11.00 a.m./12 noon on 11.7.1997. In other words, the post mortem reports suggest that the death might have occurred any time after 11.00/12.00 noon of 10.7.1997.The contention urged by reference to text books on Forensic Medicine to show the time within which rigor mortis develops all over the body also has no factual basis. It depends on various factors such as  constitution of the deceased, season of the year, the temperature in the region and the conditions under which the body has been preserved. The record indicates that the body was taken from the mortuary.We notice that there is no cross examination, whatsoever, of the doctor so as to elicit any of the material facts on which a possible argument could have been based. If these are the circumstances, then the presence of rigor mortis all over the body by itself cannot warrant the argument of the learned counsel that the death must have occurred during the previous night. Acceptable ocular evidence cannot be dislodged on such hypothetical bases for which no proper grounds were laid. 
अतः उक्त न्यायदृष्टांत के अनुसार भी आरोपीगण की उक्त प्रतिरक्षा स्वीकार योग्य नही है।
88- अब यदि अभियोजन द्वारा प्रस्तुत शेष साक्ष्य की विवेचना बंद कर दी जावे, तो भी अभियोजन प्रत्यक्षदर्शी साक्षियों के साक्ष्य के माध्यम से जिसकी पुष्टि चिकित्सीय साक्ष्य से होती है, यह प्रमाणित करने में सफल हुआ है कि उक्त उल्लेखित आरोपीगण ने मृतक महादेव महार की हत्या करने का सामान्य उद्देश्य बनाया और उक्त सामान्य उद्देश्य को अग्रसर करते हुये वे कट्टा, पिस्टल, लोहे का दांव, चाकू, लाठी आदि लेकर दो मोटर सायकल एवं मिनिडोर चैम्पियन में आये और आते ही उन्होंने मृतक महादेव से मारपीट कर उसकी हत्या कारित की और उपस्थित गवाह अ0सा07 चंदन साव को दौड़ाया। यह भी प्रमाणित हुआ है कि घटना की तत्काल सूचना टेलीफोन से अ0सा08 प्रशांत शर्मा ने थाना सुपेला को दी, जहां से तत्काल थाना सुपेला के पुलिस अधिकारी घटनास्थल पर तत्काल पहुंच गये। इस संबंध में माननीय उच्चतम न्यायालय का एक न्यायदृष्टांत अवलोकनीय है जिसमें एकमात्र प्रत्यक्षदर्शी साक्षी मृतक की पत्नि थी, उसने घटना स्वयं देखी थी, मृतक की हत्या फायर आर्म्स से की गयी थी, लेकिन फायर आर्म्स जप्त नही हुये थे और न ही उनका परीक्षण हुआ था, तब माननीय उच्चतम न्यायालय ने न्यायदृष्टांत स्टेट आफ पंजाब विरूद्ध हाकम सिंह ए 0आई0आर0 2005 पेज नम्बर 3759 का पैरा 13 में अवलोकित किया है कि:-
13. It was also pointed out by learned counsel for the respondent that no fire arms were recovered and no seizure has been made of empties. It would have been better if this was done and it would have corroborated the prosecution story. Seizure of the fire arms and recovering the empties and sending them for examination by the Ballistic expert would have only corroborated the prosecution case but by not sending them to the Ballistic expert in the present case is not fatal in view of the categorical testimony of P.W. 3 about the whole incident. 
अतः स्पष्ट है कि अ0सा01 तारकेश्वर सिंह एवं अ0सा07 चंदन साव व अन्य साक्षियों के साक्ष्य को दृष्टिगत रखते हुये यदि अभियोजन इस प्रकरण में फायर आर्म्स से संबंधित बयान मेमोरेण्डम व जप्ती को भी प्रमाणित नही कर पाता है, तब भी अभियोजन आरोपीगण की सहभागिता मृतक महादेव महार की हत्या के अपराध में प्रमाणित करने में सफल हो गया है।
भा0दं0सं0 की धारा 120 बी, 212 एवं 216 के संबध में निष्कर्ष 
89- इस प्रकरण में अभियोजन द्वारा भा0दं0सं0 की धारा 120 बी, 212 एवं 216 के आरोप को प्रमाणित करने हेतु विभिन्न आरोपियों के मोबाइल फोन की जप्ती एवं मोबाइल फोन के कॉल डिटेल्स को प्रस्तुत किया गया है। इस संबंध में अभियोजन की ओर से यह तर्क प्रस्तुत किया गया है कि भा0दं0सं0 की धारा 120 बी के अपराध को प्रमाणित करने हेतु विवेचना के दौरान यह पाया गया कि आरोपीगण आपस में मोबाइल फोन से हत्या के पूर्व आपराधिक षडयंत्र किये थे, जो उनके कॉल डिटेल्स से प्रमाणित होता है। अभियोजन की ओर से इस संबंध में माननीय उच्चतम न्यायालय का न्यायदृष्टांत ए0आई0आर0 2010 सुप्रीम कोर्ट 2352 की कण्डिका 39 में न्यायालय का ध्यान आकृष्ट किया है। अभियोजन की ओर से यह तर्क प्रस्तुत किया गया है कि आरोपी विनोद बिहारी के आधिपत्य में मोबाइल फोन नम्बर 98264-29845 था, जिसके संबंध में आरोपी विनोद बिहारी ने न्यायालय में आवेदन भी दिया था, और निवेदन भी किया था कि टॉवर से कॉल डिटेल्स प्राप्त करवाये। अभियोजन की ओर से यह भी तर्क प्रस्तुत किया गया है कि अ0सा070 हनुमान सिंह ने उसे एलॉटेड मोबाइल क्रमांक 98264-29845, आरोपी विनोद बिहारी को मोबाइल फोन नम्बर 98264-29846 आरोपी तपन को, मोबाइल नम्बर 98264-29840, आरोपी शैलेष सिंह को एवं मोबाइल नम्बर 98264-29842 आरोपी जयदीप को दिया था। अतः अभियोजन की ओर से उपस्थित होने वाले विद्वान विशेष लोक अभियोजक ने इस न्यायालय के समक्ष यह तर्क प्रस्तुत किया है कि अभियोजन द्वारा प्रस्तुत साक्ष्य के माध्यम से अभियोजन आपराधिक षडयंत्र के अपराध को प्रमाणित करने में सफल हुआ है। अतः अभियोजन के उक्त तर्क के परिप्रेक्ष्य में सर्वप्रथम यह न्यायालय मोबाइल फोन के जप्ती पत्रक, उनके कॉल डिटेल्स के संबंध में निष्कर्ष दिये जाने की ओर अग्रसर हो रही है।
मोबाइल फोन के जप्ती पत्रक
90- किसी भी मोबाइल फोन के आई.एम.ई.आई. (इन्टरनेशनल मोबाइल इक्वीपमेण्ट आईडेन्टिफिकेशन) नम्बर होता है, जिससे कोई भी मोबाइल पहचाना जाता है। इसी मोबाइल के अंदर एक सिम होता है, जिसका अपना विशेष नम्बर होता है, लेकिन इस प्रकरण के जो मोबाइल फोन जप्त किये गये हैं, उसके जप्ती पत्रक क्रमशः प्रदर्श पी 49, प्रदर्श पी 57, प्रदर्श पी 58, प्रदर्श पी 61, प्रदर्श पी 62, प्रदर्श पी 63, प्रदर्श पी 65, प्रदर्श पी 73, प्रदर्श पी 91, प्रदर्श पी 98, प्रदर्श पी 108, प्रदर्श पी 115, प्रदर्श पी 140 है। कुछ जप्ती पत्रकों को छोड़कर किसी भी जप्ती पत्रक के किसी भी मोबाइल फोन का आई.एम.ई.आई. नम्बर अंकित नही है। इसी प्रकार इस प्रकरण में जो कॉल डिटेल्स प्रस्तुत किये गये हैं, उन कॉल डिटेल्स में भी मोबाइल फोन के आगे उसका आईएमईआई नम्बर अंकित नही है। इसके अतिरिक्त प्रकरण में मोबाइल हैण्डसेट में स्वामित्व को प्रमाणित करने हेतु (आरोपी मंगलसिंह के मोबाइल के स्वामित्व को छोड़कर) ऐसा कोई भी रसीद या दस्तावेज या आवेदन आदि प्रस्तुत नही किया गया है, जिससे यह प्रमाणित हो सके कि जप्त मोबाइल अमुक व्यक्ति के स्वामित्व का है या उसे अमुक आरोपी ने क्रय किया था।
